    Abstract

    Penelitian ini dilatarbelakangi tingginya angka kekerasan di lingkungan satuan pendidikan di Indonesia, termasuk di Kota Bandung, yang mengancam pemenuhan hak asasi manusia peserta didik dan kualitas pendidikan nasional. Sebagai bentuk tanggung jawab negara hukum, pemerintah menetapkan Permendikbudristek Nomor 46 Tahun 2023 tentang Pencegahan dan Penanganan Kekerasan di Lingkungan Satuan Pendidikan. Penelitian ini bertujuan untuk menganalisis implementasi kebijakan tersebut di SMP Kota Bandung sebagai upaya perlindungan hukum bagi anak kekerasan, dengan fokus pada strategi pencegahan dan penanganan, bentuk perlindungan hukum, serta kendala pelaksanaan kebijakan. Pendekatan yang digunakan adalah kualitatif dengan metode studi kasus. Teknik pengumpulan data meliputi observasi, wawancara mendalam, dan dokumentasi, dengan informan yang terdiri dari anggota Tim Pencegahan dan Penanganan Kekerasan (TPPK), peserta didik dan Satuan Tugas (Satgas) PPKSP Kota Bandung. Hasil penelitian menunjukkan bahwa (1) strategi pencegahan dan penanganan kekerasan telah dilakukan melalui pembentukan TPPK, sosialisasi materi antikekerasan, pembiasaan perilaku positif, serta penyediaan berbagai kanal pelaporan langsung maupun tidak langsung; (2) bentuk perlindungan hukum bagi anak mengacu pada perundang-undangan yang berasas kepada non diskriminasi dan keadilan melalui pendampingan psikis, penyelidikan, penuntutan hingga kepada pemeriksaan di sidang pengadilan; dan (3) kendala yang dihadapi meliputi keterbatasan pemahaman hukum anggota TPPK, minimnya sumber daya manusia, serta koordinasi lintas sektor yang belum optimal. Penelitian ini menegaskan pentingnya penguatan kapasitas, pelatihan berkelanjutan, serta kolaborasi semua pihak agar perlindungan hukum peserta didik di sekolah dapat terwujud secara substantif, tidak hanya administratif. This research was motivated by the high incidence of violence in educational institutions in Indonesia, including in the city of Bandung, which threatens the fulfilment of students' human rights and the quality of national education. As part of its responsibility as a constitutional state, the government issued Permendikbudristek No. 46 of 2023 concerning the Prevention and Handling of Violence in Educational Institutions. This study aims to analyse the implementation of this policy in junior high schools in Bandung City as a legal protection measure for children who are victims of violence, focusing on prevention and handling strategies, forms of legal protection, and obstacles to policy implementation. A qualitative approach was used with a case study method. Data collection techniques included observation, in-depth interviews, and documentation, with informants consisting of members of the Violence Prevention and Handling Team (TPPK), students, and the Bandung City PPKSP Task Force (Satgas). The results of the study show that (1) strategies for preventing and handling violence have been implemented through the formation of the TPPK, the dissemination of anti-violence materials, the promotion of positive behaviour, and the provision of various direct and indirect reporting channels; (2) legal protection for children refers to legislation based on non-discrimination and justice through psychological assistance, investigation, prosecution, and examination in court; and (3) obstacles encountered include limited legal understanding among TPPK members, lack of human resources, and suboptimal cross-sector coordination. This study emphasises the importance of capacity building, continuous training, and collaboration among all parties so that the legal protection of students in schools can be realised substantively, not just administratively.
