Abstract

Penelitian ini dilatarbelakangi oleh masalah pengamen dan pengemis di Kota Bandung yang cenderung mengalami peningkatan di tiap tahunnya, padahal Peraturan Daerah Kota Bandung No.9 Tahun 2019 tentang Ketertiban Umum, Ketentraman, dan Perlindungan Masyarakat telah dengan jelas mengatur terkait larangan yang disertai dengan aturan penanganannya. Untuk itu, penelitian ini bertujuan untuk menganalisis implementasi kebijakan Peraturan Daerah Kota Bandung No.9 tahun 2019 dengan menggunakan pendekatan multidimensional yang menggabungkan berbagai perspektif dari pihak yang terlibat dalam keberhasilan pelaksanaan kebijakan. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus serta teknik pegumpulan data yang terdiri dari studi dokumentasi, wawancara dan observasi. Penelitian ini melibatkan partisipan yang terbagi kedalam tiga kategori yaitu, pelaksana kebijakan yakni Dinas Sosial dan satpol PP, pihak terdampak kebijakan yaitu pelaku dan masyarakat, serta pembuat kebijakan yakni DPRD Kota Bandung. Hasil penelitian menunjukkan bahwa implementasi kebijakan belum berjalan dengan optimal. Hambatan dari implementasi datang dari pelaksanaan kebijakan yang kurang efektif dari segi komunikasi, sumber daya, disposisi dan birokrasi, yang didiperkuat oleh rendahnya kesadaran dan kepatuhan hukum masyarakat dan pelaku terhadap peraturan. Maka dari itu dibutuhkan perbaikan yang terstruktur dan sistematis, dimulai dari perbaikan birokrasi melalui intergrasi program, perbaikan sumber daya melalui peningkatan kualitas personel, perbaikan komunikasi melalui sosialisasi, dan perbaikan disposisi melalui peningkatan citra pelaksana kebijakan. This research is motivated by the issue of street musicians and beggars in the city of Bandung, which tends to increase each year, despite the existence of Bandung City Regional Regulation No. 9 of 2019 concerning Public Order, Peace, and Community Protection, which clearly regulates the prohibition and its handling procedures. Therefore, this study aims to analyze the implementation of the policy of Bandung City Regional Regulation No. 9 of 2019 using a multidimensional approach that combines various perspectives from parties involved in the successful implementation of the policy. This research uses a qualitative approach with a case study method and data collection techniques consisting of documentation studies, interviews, and observations. The study involves participants divided into three categories: policy implementers (the Social Service and Public Order Agency/Satpol PP), those affected by the policy (street performers and the public), and policy makers (the Bandung City Regional House of Representatives/DPRD). The findings indicate that the policy implementation has not been optimal. The obstacles to implementation stem from ineffective execution in terms of communication, resources, disposition, and bureaucracy, compounded by the low legal awareness and compliance of the public and street actors with the regulation. Therefore, structured and systematic improvements are needed, starting with bureaucratic reform through program integration, resource enhancement through personnel quality improvement, communication improvement through public outreach, and disposition improvement through enhancing the image of policy implementers.
