Abstract
Penelitian ini dilatarbelakangi karena melihat kondisi di lapangan, dimana penyandang cacat masih belum sepenuhnya menikmati hak-hak dasar mereka sebagai warga masyarakat yaitu kesempatan memperoleh pekerjaan. Peraturan Daerah Kota Bandung Nomor 26 Tahun 2009 mengamanatkan bahwa pemerintah dan pengusaha wajib memberikan kesempatan yang sama kepada tenaga kerja penyandang cacat sesuai dengan jenis dan derajat kecacatannya. Pendekatan penelitian ini menggunakan penelitian kualitatif dengan metode penelitian deskriptif. Partisipan penelitian ini adalah kepala bagian penempatan tenaga kerja Dinas Tenaga Kerja Kota Bandung, Kasi rehabilitas sosial penyandang disabilitas Dinas Sosial Kota Bandung, perusahaan, dan penyandang cacat. Data yang diperoleh melalui teknik wawancara, observasi, dan studi dokumentasi. Berdasarkan hasil penelitian mengungkapkan bahwa: 1) Penyandang cacat belum puas dengan penerapan Perda Kota Bandung Nomor 26 Tahun 2009 dikarenakan mereka masih merasa kesulitan mendapatkan pekerjaan; 2) Hambatan yang ditemukan pada penerapan Perda Kota Bandung Nomor 26 Tahun 2009 adalah kurangnya sosialisasi, lemahnya pengawasan di lapangan, kurangnya kesadaran para pengusaha untuk memperkerjakan penyandang cacat, perusahaan takut tidak bisa memperlakukan karyawan penyandang cacat dengan semestinya, aksesbilitas yang belum tersedia, serta keterbatasan keterampilan yang dimiliki; 3) Upaya pemerintah Kota Bandung untuk mengatasi hambatan yang muncul di lapangan adalah melakukan sosialisasi berkelanjutan mengenai keharusan memperkerjakan penyandang cacat kepada perusahaan, pengembangan pelatihan-pelatihan keterampilan bagi penyandang cacat dan melalukan pengawasan pelaksanaan di lapangan; 4) Hasil penerapan Perda Kota Bandung Nomor 26 Tahun 2009 belum berjalan secara optimal. Implementation of Government Regional of Bandung City Number 26 of 2009 Concerning Equality and Empowering Disabilities People in Increasing Job Opportunities (Descriptive Study in Bandung City) The research was motivated by looking the field condition, where disabilities people still cannot enjoy their basic rights as citizens fully; the opportunity to get a job. Government regional of Bandung city number 26 of 2009 entrusts that government and entrepreneur have to give the same opportunity to the disabilities employees based on the kind and the degree of their disablements. This research approach used qualitative research with the descriptive research methode. This research participants were the head of the labor placement department of the Bandung City Labor Service, The head section of social rehabilitation for disabilities people in the Bandung City Social Service, companies, and disabilities people. Data obtained through interview, observation, and documentation study techniques. Based on the result of the research, it showed that; 1) Disabilities people are not satisfied with the application of Government Regulation of Bandung city Number 26 of 2009 because they still find the difficulties to get a job; 2) The obstacles which are found in the application of Government Regulation of Bandung city Number 2009 are lack of socialization, weak of the supervision in the field, lack of the awareness of the entrepreneurs to give a job for the disabilities people, the companies are afraid that they cannot properly treat the disabilities employees, the accessibility which is not yet available, and the limitations skills possessed; 3) The efforts of the Bandung city’s government to overcome the appear obstacles in the field are doing the continue socialization about the must to give the job to the disabilities people and do the implementation supervision in the field; 4) The implementation result of the Regulation Government of Bandung city Number 26 of 2009 does not run optimally.
