Abstract

Latar belakang dari penelitian ini merujuk pada peraturan pemerintah yang beradu dengan Warga RW 11 Kelurahan Tamansari Kota Bandung. Tujuan dari penelitian ini untuk mengidentifikasi dan menganalisis pandangan warga dan penyebab konflik horizontal terhadap pembangunan rumah deret di RW 11 Kelurahan Tamansari Kota Bandung serta upaya yang dilakukan oleh masyarakat dan pemerintah dalam menyelesaikan konflik tersebut. Desain penelitian menggunakan pendekatan kualitatif dengan metode Studi Kasus. Hasil penelitian menunjukan diantaranya; (1) Pandangan warga terbagi menjadi dua bagian yaitu Warga Pro dan Warga Kontra, (2) Warga Kontra masih menempati dan bertahan dengan tempat tinggal mereka karena mereka mepunyai prinsip dan landasan hukum bahwa tempat tinggal mereka merupakan tanah mereka yang sah secara hukum dan keyakinan., (3) Berbeda dengan Warga Kontra, Warga Pro mengikuti arahan pemerintah untuk meninggalkan tempat tinggal mereka dan siap menempati rumah deret pada saat selesai pembangunan, karena Warga Pro merasa diuntungkan dengan tidak ada biaya sewa dan tahun keenam 50% potongan biaya sewa, juga mendapatkan uang rohimat sebesar 20 % dari taksiran harga tempat tinggal mereka. Adapun simpulan dari penelitian ini diantaranya; (1) pandangan warga terhadap penggusuran lahan dan pembangunan rumah deret terbagi menjadi dua pandangan yaitu warga pro dan warga kontra, (2) faktor penyebab konflik horizontal antar warga ini disebabkan oleh perbedaan pandangan juga adanya intervensi sesama warga, (3) upaya untuk menyelesaikan konflik horizontal antar warga dilakukan oleh Pemerintah Kota Bandung dengan cara sosialisasi dan musyawarah. Musyawarah dan sosialisasi dilakukan sebelum penggusuran lahan, lalu pada saat proses penggusuran lahan dan pembangunan rumah deret dan terakhir pasca penggusuran dan proses pembangunan rumah deret. The background of this study refers to government regulations that conflict with residents of RW 11 Tamansari Village, Bandung City. The purpose of this study was to identify and analyze the views of residents and the causes of horizontal conflict over the construction of row houses in RW 11 Tamansari Village, Bandung City and the efforts made by the community and the government in resolving the conflict. The research design uses a qualitative approach with the Case Study method. The results of the research show that among others; (1) The views of the residents are divided into two parts, namely Pro and Cons Residents, (2) Cons Residents still occupy and survive with their homes because they have principles and a legal basis that their residence is their legal land according to law and belief. , (3) Unlike the Cons Residents, Pro Residents follow the government's directives to leave their residence and are ready to occupy row houses when construction is completed, because Pro Residents benefit from no rental fees and in the sixth year 50% discount on rental costs, also get rohimat money of 20% of the estimated price of their residence. The conclusions from this study include; (1) the views of residents on land eviction and the construction of row houses are divided into two views, namely pro and cons, (2) the causes of horizontal conflict between residents are caused by different views as well as the intervention of fellow residents, (3) efforts to resolve conflicts horizontally between residents is carried out by the Government of Bandung City by way of socialization and deliberation. Deliberations and socialization were carried out before land clearing, then during the process of land eviction and row house construction and finally after the eviction and row house construction process.
