Abstract
Kota Bandung merupakan kota besar yang memiliki masalah mengenai kawasan atau daerah dan fasilitas bagi para pejalan kaki. Tata kota yang salah, pemberian izin usaha yang terlalu mudah, berkumpulnya kawasan usaha di satu tempat, padatnya tingkat kendaraan, perkir liar dan pedagang kaki lima membuat kota Bandung menjadi tidak teratur, kacau, dan membuat disfungsi trotoar mengakibatkan terlanggarnya hak pejalan kaki. Kondisi yang dialami pejalan kaki di Kota Bandung menjadikan topik perlindungan hukum pada pejalan kaki menarik untuk diteliti. Tujuan umum penelitian untuk mengetahui permasalahan yang dihadapi oleh pejalan kaki di jalan-jalan protokol perkotaan; perbedaan yang terjadi antara peraturan yang ditetapkan oleh Pemerintah Kota Bandung dengan peraturan perundang-undangan lainnya dengan kenyataan yang terjadi; untuk mengetahui dampak tidak teraturnya lalu lintas di Kota Bandung, termasuk pejalan kaki. Tujuan khusus untuk mengetahui akar permasalahan yang mengakibatkan banyak terlanggarnya hak-hak pejalan kaki di Kota Bandung; untuk mengetahui efektivitas peraturan-peraturan mengenai perlindungan pejalan kaki di Kota Bandung; untuk mengetahui langkah-langkah yang perlu dilakukan oleh pihak-pihak yang berwenang untuk mengatasi masalah yang dihadapi oleh pejalan kaki. Penelitian ini menggunakan penelitian deskriplif analitik dengan metode pendekatan kualitatif dengan metode studi kasus. Data dikumpulkan dengan observasi, wawancara, dan studi dokumen dan kepustakaan. Penelitian ini menemukan bahwa buruknya penataan terhadap jalan dan trotoar berhubungan erat dengan penataan Kota Bandung yang tidak tepat. Faktor-faktor yang melatarbelakangi sulitnya penataan terhadap kota, maupun jalan dan trotoar ini antara lain: ruang Kota Bandung yang semakin sempit, faktor sosial ekonomi, tingginya pendatang, dan kebijakan Pemerintah Kota Bandung yang tidak tepat. Perlindungan hukum terhadap pejalan kaki Kota Bandung juga masih bersifat pasif, perlindungan hukum yang bersifat aktif masih belum terbina pada para pejalan kaki Kota Bandung, karena belum pahamnya pejalan kaki akan hak dan kewajibannya. Bandung is a big city which has a problem on areas and facilities for pedestrians. Wrong city planning, easiness in granting business license, gathering of the business place in one area, the density level of the vehicle, illegal parking and street hawkers are making Bandung chaotic, and also make the sidewalks dysfunction resulting in violation of pedestrians’ rights. Conditions experienced by pedestrians in the city of Bandung makes the topic of legal protection upon pedestrians interesting to study. The general objective of the research to find out the problems faced by pedestrians in the urban protocol streets; differences that occur between the regulations set by the Government of Bandung with other legislation with the way it is; to determine the impact of irregular traffic in Bandung , including pedestrians. Specific objectives: to determine the root causes that resulted in a lot of violation of the rights of pedestrians in the city of Bandung, to determine the effectiveness of the regulations regarding the protection of pedestrians in the city of Bandung, to know steps that need to be done by the appropriate authorities to solve the problem faced by pedestrians This research use qualitative descriptive analytic approach with case study method. Data were collected by observation, interviews and document studies and literature. The study found that the poor arrangement of the roads and pavements is closely related to the improper arrangement of city of Bandung. The factors underlying the difficulty of structuring the city, and the roads and sidewalks, among other things: Bandung space is increasingly narrow, socio-economic factors, high arrivals of people, and the policy of the City of Bandung is not appropriate. Legal protection of pedestrians Bandung is still passive, active protection of the law is still not built up on the pedestrian Bandung, because the pedestrians haven’t fully understand their rights and obligations.
