Abstract
ABSTRAK IMPLEMENTASI PERATURAN DAERAH KOTA BANDUNG NOMOR 04 TAHUN 2011 TENTANG PENATAAN DAN PEMBINAAN PEDAGANG KAKI LIMA DALAM MEMBANGUN KESADARAN HUKUM MASYARAKAT MENGENAI KEBIJAKAN ZONA MERAH Penelitian ini dilatarbelakangi dengan permasalahan yang terjadi di kawasan zona merah bagi PKL di Kota Bandung dimana pelaksanaan dari Perda Kota Bandung Nomor 04 Tahun 2011 belum sepenuhnya dapat dilaksanakan secara maksimal. Penelitian ini bertujuan untuk mengetahui sejauh mana implementasi Perda Kota Bandung Nomor 04 Tahun 2011 untuk membangun kesadaran hukum masyarakat mengenai kebijakan zona merah. Dalam penelitian ini terdapat empat rumusan masalah, yaitu (1) Bagaimana latar belakang penyusunan kebijakan Pemerintah Kota Bandung mengenai penerapan zona merah di Kota Bandung?; (2) Bagaimana peran Peraturan Daerah Kota Bandung Nomor : 04 Tahun 2011 tentang penataan dan pembinaan pedagang kaki lima untuk membangun kesadaran hukum masyarakat?; (3) Sejauh mana efektivitas penerapan zona merah dalam rangka membangun kesadaran hukum masyarakat?; (4) Bagaimana tindakan pemerintah jika terdapat PKL atau masyarakat yang terbukti melanggar di kawasan zona merah?. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus terhadap beberapa subjek penelitian diantaranya para PKL, masyarakat, DPRD Kota Bandung, dan SatPol PP Kota Bandung. Pengumpulan data dilakukan dengan cara observasi, studi dokumentasi, wawancara, studi literasi dan catatan lapangan selanjutnya dilakukan analisis data dengan menggunakan reduksi data, penyajian data, triangulasi dan penarikan kesimpulan. Hasil dari penelitian ini menunjukan bahwa: (1) Perda Kota Bandung Nomor 04 Tahun 2011 sendiri dilatarbelakangi dengan tujuan dari pemerintah Kota Bandung untuk menjadikan Kota Bandung sebagai tujuan wisata maka diharapkan Kota Bandung menjadi aman, bersih dan tertib; (2) Peran Perda Kota Bandung Nomor 04 Tahun 2011 mempunyai fungsi dan tujuan untuk menjadikan Kota Bandung lebih nyaman, tertata serta mengembalikan fasilitas umum kembali sesuai fungsinya, serta sebagai alat dan sarana bagi pemerintah untuk menjadikan masyarakat lebih sadar terhadap hukum yang berlaku; (3) Dalam pelaksanaan sudah sesuai dengan Perwal Kota Bandung Nomor 571 Tahun 2014, namun kondisi dilapangan dimana kesadaran hukum masyarakat masih kurang maka diketahui bahwa efektivitas Perda ini belum sepenuhnya berjalan maksimal; (4) Sanksi yang diberikan bagi pelanggar zona merah ialah, bagi masyarakat sendiri hanya diberikan imbauan atau teguran saja, sedangkan bagi PKL diberikan sanksi administrasi yaitu penyitaan tanda pengenal yang kemudian di proses melalui persidangan. ABSTRACT THE IMPLEMENTATION OF BANDUNG CITY REGIONAL REGULATION NUMBER 04 YEAR 2011 ABOUT THE PLANNING AND DEVELOPMENT OF THE STREET VENDORS IN CREATING SOCIETY’S LEGAL AWARENESS ON THE RED ZONE POLICY This study is motivated by the problem that occurs in the red zone area for street vendors in which its implementation based on Bandung City Regional Regulation Number 04 Year 2011 is not fully implemented maximally. This study aims at investigating to what extent the implementation of Bandung City Regional Regulation Number 04 Year 2011 in creating society’s legal awareness regarding the red zone policy. This study consists of four research problems, which are (1) How is the background of policy arrangement by the government of Bandung City on the implementation of red zone in Bandung City?; (2) How is the role of Bandung city regional regulation Number 04 Year 2011 about the planning and development of the street vendors in creating society’s legal awareness?; (3) How is the effectivity of red zone implementation in creating society’s legal awareness?; (4) How is the government action if there is street vendor or the society who does violation in the red zone area?. This study uses qualitative approach with case study method on some research subjects such as street vendors, society, Regional People's Representative Assembly of Bandung City, Municipal Police of Bandung City. The data collection is conducted by doing observation, documentation study, interview, literacy study, and field notes. Then, the data will be analyzed by employing data reduction, data presentation, triangulation, and deciding a conclusion. The result of this study shows that (1) Bandung City Regional Regulation Number 04 Year 2011 is based on the purpose of Bandung City government to be a tourist destination, so that Bandung City is expected to be safe, clean, and orderly; (2) the role of Bandung City Regional Regulation Number 04 Year 2011 has function and purpose to make Bandung City more comfortable, orderly, and restore public facility based on its function, and roles as the tool and medium for the government to make society aware on the legal applied; (3) its implementation is suitable to regulation of Bandung City Mayor Number 571 Year 2014, but the reality signifies that society’s legal awareness is still less, so that the effectivity of this regional regulation is not fully run maximally; (4) the sanction given to the red zone violator for the society is only a suggestion or warning, while street vendors obtain administrative sanction, which is confiscation of ID card, that then will be processed into the court.
