Abstract
Peran Brimob dalam penanganan demonstrasi yang anarkis harus dilakukan secara profesional guna meminimalisasi dampak konflik. Untuk itu, diperlukan ketepatan tindakan. Pertama, peran Brimob dalam penanganan demonstrasi untuk menyelesaikan konflik. Kedua, aktualisasi profesionalisme Brimob dalam penanganan demonstrasi. Ketiga, konstruksi peran Brimob dalam penanganan demonstrasi secara profesional sebagai wujud penegakan hukum. Keempat, perspektif pendidikan kewarganegaraan pada peran Brimob dalam penanganan demonstrasi secara profesional sebagai wujud penegakan hukum. Penelitian ini dilaksanakan di Jawa Barat (Cileungsi, Bogor; Karawang; dan Bandung). Subjek penelitian ini adalah anggota Brimob dan pekerja yang berdemonstrasi. Penelitian ini bertujuan untuk mengetahui peran Brimob dalam penanganan demonstrasi secara profesional sebagai wujud penegakan hukum, sehingga warganegara dapat melakukan demonstrasi secara benar dan disertai penyelesaian konflik secara aman dan tertib. Metode penelitian menggunakan Grounded Theory dengan pendekatan kualitatif. Teknik pengumpulan data menggunakan metode triangulasi sumber data. Pengolahan data melalui Open Coding, Axial Coding, Selective Coding. Hasil temuan dalam penelitian ini: Pertama, Brimob sebagai layer ketiga dalam penanganan demonstrasi masih sangat diperlukan di Indonesia. Adanya tindakan anarkis dalam aksi demonstrasi menunjukkan bahwa masih banyak yang tidak memahami norma-norma dan prosedur pelaksanaan demonstrasi. Untuk itu, pendekatan metode Crowd Control masih relevan untuk saat ini, namun perlu sedikit penyesuaian agar tidak merugikan salah satu pihak. Kedua, profesionalisme dalam penanganan demonstrasi bersumber pada reliability, tangibles, responsiveness, assurance, dan empathy, namun, mengalami hambatan diantaranya belum terpenuhinya rasio kekuatan anggota, sarana PHH dan rantis tidak memadai, terjadinya human error serta tidak ada pengawalan mediasi hingga tuntas. Ketiga, profesionalisme harus dibarengi dengan penegakan hukum yang tegas serta meningkatkan kerjasama internal dan eksternal. Keempat, kesetimbangan asas menjauhkan sifat anarki. Perlu adanya sosialisasi untuk menyamakan persepsi tentang norma-norma yang berlaku. Penulis merekomendasikan, peran Brimob dalam penanganan demonstrasi pada penyelesaian konflik dari tindakan pengawalan mediasi hingga tuntas mendapatkan win-win solution. Kendala diatasi dengan melakukan penambahan kekuatan anggota, penambahan sarana PHH dan rantis, dan penambahan biaya akomodasi; efisiensi penanganan demonstrasi dengan meningkatkan koordinasi dan keterpaduan administrasi antara satwil, Sat Brimob, dan Polda. Penanganan demonstrasi melibatkan para pihak terkait, serta perlu ada kerjasama psikolog demonstrasi dengan komandan kompi di lapangan untuk meminimalisasi human error. Perspektif PKn pada penanganan demonstrasi menumbuhkan norma religius, hukum, kesusilaan, dan etika bagi semua pihak terkait. ;--- The role of Brimob (the Mobile Brigade) in policing anarchistic demonstration must be done in a professional manner. It is to minimize the possibly arising conflict impacts. This requires several precision actions. The first is the role of Brimob in demonstration policing to resolve the conflict. The second is the actualization of Brimob’s professionalism in the demonstration policing. The third is the construction of the role of Brimob in the demonstrations policing professionally. The fourth is the perspective of civic education on the role of Brimob in demonstration policing professionally as a form of law enforcement. This study was conducted in West Java (Cileungsi, Bogor; Karawang; and Bandung). The subjects were the members of Brimob and the demonstrating workers. This study aims to determine the role of Brimob in policing demonstration professionally with the right policies, so that citizens can do the demonstration correctly with conflict resolution safely and orderly. The research method employed Grounded Theory with qualitative approach. The data collection technique used data triangulation through multiple sources (observation, interviews, documentation). The data processing was conducted by Open Coding, Axial Coding, Selective Coding. The findings in this study include: Brimob which acts as the third layer in demonstration policing is still required in Indonesia. The occasional incidence of anarchistic demonstration showed that there are those who do not understand the norms and procedure to put demonstration into practice. Hence, crowd control method is considered relevant for the time being. Secondly, securing professionalism in demonstration policing, which relies on reliability, tangibles, responsiveness, assurance and empathy, is hindered by factors such as the inadequate ratio of personnels as compared to demonstrators, the lack of PHH equipments and tactical vehicles, human error and the absent of mediation assurance. Thirdly, professionalism should be accompanied by a clear law enforcement and improving internal and external cooperation. Lastly, proportionality in public protest principles and policing principles would keep us clear of anarchic behavior. Therefore, socialization to equate perceptions on available norms is vital. It is recommended that Brimob should guard the process of mediation to ensure win-win solution for all parties. Difficulties in handling demonstrations are handled by recruitment to approach the ideal number of personnels, more PHH equipments and tactical vehicles, and more accommodation allocation. There should be improvement in administrative coordination and integration between satwil (Area Unit), the Sat Brimob, and the Polda. Demonstrations policing involves concerned parties in a comprehensive manner, and there is the need of demonstration psychologist that would cooperate with field commanders to minimize human error. The perspective of civic education in the demonstration policing would foster the norms of religious, laws, morals, and ethics for all concerned parties.
