Abstract
Tanah merupakan salah satu faktor yang paling penting dalam kehidupan manusia baik sebagai sumber penghidupan maupun sebagai tempat berpijak manusia untuk kelangsungan hidup manusia. Tanah sangat rentan oleh berbagai sengketa dan penyalahgunaan oleh pihak lain yang ingin menguasai tanah tersebut. Untuk menjaga tanah yang di miliki oleh masyarakat, maka pemilik tanah di kelurahan Tarikolot perlu mendaftarkan tanah mereka agar mendapatkan Sertifikat tanah sebagai alat pembuktian yang paling kuat bagi pemilik tanah di kelurahan Tarikolot. Namun pemilik tanah di kelurahan Tarikolot masih belum memiliki kesadaran hukum untuk memiliki sertifikat hak milik. Ada beberapa faktor yang menyebabkan mereka belum memiliki Sertifikat Hak Milik yaitu faktor yang paling utama karena alasan ekonomi, yang mana dalam proses pembuatan Sertifikat Hak Milik memerlukan biaya yang besar, sedangkan pendapatan masyarakat kelurahan Tarikolot masih kecil dimana mayoritas penduduknya hanya bermata pencaharian sebagai petani dan buruh tani. Masyarakat tidak mengetahui syarat dan prosedur dalam membuat Sertifikat Hak Milik, dan masyarakat kelurahan Tarikolot tidak mengetahui hukum formal yang mengatur masalah pertanahan, hal tersebut di akibatkan karena tingkat pendidikan masyarakat kelurahan Tarikolot masih rendah, alasan lainnya adalah karena waktu untuk memproses Sertifikat Hak Milik membutuhkan waktu yang lama sehingga masyarakat malas untuk untuk memprosesnya. Untuk memudahkan dalam memahami penelitian ini dirumuskan dalam 4 rumusan masalah yaitu: 1) Apakah dengan tingkat pendapatan yang memadai pemilik tanah akan membuat Sertifikat Hak Milik?, 2) Apakah dengan tingkat pendidikan yang tinggi pemilik tanah akan membuat sertifikat hak milik?, 3) Apakah dengan waktu yang relatif singkat pemilik tanah akan membuat Setrifikat Hak Milik?, 4) Apakah dengan biaya murah pemilik tanah akan membuat Sertifikat Hak Milik?. Penelitian ini menggunakan pendekatan kualitatif dan metode studi kasus. Adapun teknik yang digunakan adalah observasi, wawancara, studi dokumentasi dan studi literatur. Subjek penelitian yang di pakai adalah pemilik tanah yang tidak memiliki sertifikat Hak Milik, kepala kelurahan Tarikolot dan Pihak kantor Badan Pertanahan Kabupaten Majalengka. Hasil dari penelitian ini adalah 1) pendapatan masyarakat kelurahan Tarikolot tidak memadai sehingga pemilik tanah belum memiliki Sertifikat Hak Milik, 2) masyarakat kelurahan Tarikolot banyak yang tidak mengetahui prosedur dan syarat-syarat dalam proses pembuatan sertifikat hak milik yang disebabkan oleh tingkat pendidikan yang masih rendah, 3) jika dalam pembuatan sertifikat hak milik tersebut tidak memerlukan waktu yang lama dan proses yang rumit maka pemilik tanah di kelurahan Tarikolot akan membuat sertifikat Hak Milik, 4) faktor biaya yang mahal menjadi alasan para pemilik tanah belum membuat sertifikat Hak Milik. Kesimpulan dari penelitian ini yaitu bahwa tingkat kesadaran pemilik tanah di kelurahan Tarikolot untuk memiliki Sertifikat Hak Milik masih rendah atau kurang. Masyarakat kelurahan Tarikolot belum memiliki Sertifikat Hak Milik disebabkan oleh beberapa alasan yaitu karena tingkat pendapatan masyarakat di kelurahan Tarikolot masih rendah, tingkat pendidikan masyarakat di kelurahan Tarikolot masih rendah, waktu dalam proses pembuatan Sertifikat Hak Milik memerlukan waktu yang lama dan karena faktor biaya dalam proses pembuatan Sertifikat Hak Milik memerlukan biaya yang sangat mahal. Land is one of the most important factors in human life as source of life and human place for people survival. Land is very susceptible to lawsuit and abused by people who want to have the land. For saving societies’ land, the legal owner of land in Tarikolot should have a certificate as the strongest proof. But, they have low awareness about law for having a certificate. There are some factors that make them have not had a certificate yet. First of all, economy. Economy is the main factor that makes them have no certificate because for making a certificate they should have much money. Besides, the major of them who are farmer have low income. They do not know about requirement and procedure for making a certificate. Afterwards, the society of Tarikolot does not know about formal law that organize about land affair. It is because they have low education level. Second, time. They need much time for making a certificate which makes them lazy for processing it. For making it easy to be understood, the writer identifies 4 research questions, such as: 1) Will high income make the legal owners of lands have a certificate?, 2) Will high education make the legal owners of lands have a certificate?, 3) Will the legal owner of lands make a certificate if it do not waste time?, 4) Will the legal owner of lands make a certificate if the cost is not expensive?. This research uses qualitatif as the research design and case study as the research method. For collecting the data the writer uses observation, interview, documentation and literary study. The writer takes the legal owner of land that have no certificate, head of Tarikolot village and party of Land Corporation of Majalengka as the research subject. The results of this study are; 1) The income of society of Tarikolot is low, so they have not had a certificate yet, 2) The major of society of Tarikolot do not know about requirement and procedure for making a certificate because of low education, 3) If make a ceritificate is not complicated and do not need much time, the legal owners of lands will make a certificate 4) They have not had a certificate yet because the cost for making it is expensive. The conclusion of this research is the awareness of Tarikolot’s society to make a certificate is low. Some factors that make them have not had a certificate yet are low income, low education, need much time for making certificate and the cost which is expensive
