Abstract

Penelitian ini bertujuan untuk menganalisis peran hukum adat Suku Bajo sebagai instrumen pemenuhan hak bermukim di atas laut, serta mengevaluasi bagaimana hukum nasional melalui peraturan dan kebijakan yang berlaku dapat mengakomodasi hak serupa bagi masyarakat Suku Bajo di Mola Kabupaten Wakatobi. Permasalahan yang diangkat berangkat dari kondisi ketidakpastian hukum yang dihadapi komunitas adat pesisir tersebut, yang selama puluhan tahun tinggal di atas laut tanpa kepastian legal formal atas tempat tinggalnya, meskipun telah hidup secara turun-temurun. Penelitian ini menggunakan pendekatan kualitatif dengan jenis studi kasus. Teknik pengumpulan data dilakukan melalui wawancara mendalam dengan tokoh adat Suku Bajo, tokoh adat Sara Mandati, dan perwakilan pemerintah daerah Wakatobi, dilengkapi dengan Focus Group Discussion bersama Lembaga Adat Sara Mandati, serta studi dokumentasi terhadap dokumen hukum dan kebijakan yang relevan. Pendekatan ini memungkinkan penelusuran secara kontekstual dan mendalam terhadap dinamika hubungan antara hukum adat dan hukum nasional dalam tata kelola ruang hidup komunitas pesisir. Hasil penelitian menunjukkan bahwa hukum adat Sara Mandati masih aktif mengatur distribusi hak mendirikan rumah dan sengketa lahan pada pemukiman suku Bajo, melalui prinsip hak pakai komunal. Negara baru mengakui keberadaan pemukiman tersebut secara formal dalam dua tahap, yakni pengakuan bersyarat melalui reklamasi, dan pengakuan formal melalui kebijakan PKKPRL dengan penerbitan Sertifikat Hak Guna Bangunan. Penelitian ini menyimpulkan adanya praktik pluralisme hukum yang membentuk struktur hukum hybrid, di mana hukum adat dan hukum nasional berjalan beriringan namun tetap menyisakan ketegangan yurisdiksi. Temuan ini penting sebagai landasan bagi perumusan kebijakan yang lebih inklusif terhadap komunitas adat pesisir. This study aims to analyze the role of Adat Law of the Bajo people as an instrument for fulfilling the right to reside over the sea, and to evaluate how national law, through applicable regulations and policies, can accommodate similar rights for the Bajo community in Mola Wakatobi Regency. The issue raised stems from the legal uncertainty faced by this coastal indigenous community, which for decades has lived above the sea without formal legal certainty over their residences, despite having lived there for generations. This research employs a qualitative approach with a case study design. Data collection techniques include in-depth interviews with traditional leaders of the Bajo people, traditional leaders of Sara Mandati, and representatives of the Wakatobi local government, complemented by Focus Group Discussions with the Adat Institution of Sara Mandati, and documentation studies on relevant legal documents and policies. This approach allows for contextual and in-depth exploration of the dynamics between Adat Law and national law in governing the living space of coastal communities. The research findings show that the Adat Law of Sara Mandati remains actively regulating the distribution of housing rights and land disputes in Bajo settlements through the principle of communal use rights. The state only formally recognized the settlement in two stages: conditional recognition through reclamation, and formal recognition through the PKKPRL policy with the Sertifikat Hak Guna Bangunan. This study concludes that there is a practice of legal pluralism that forms a hybrid legal structure, where Adat Law and national law operate in parallel, though jurisdictional tensions persist. These findings are important as a basis for formulating more inclusive policies for coastal indigenous communities.
