Abstract

Setiap perempuan memiliki berbagai tantangan yang beragam, khususnya perempuan di
Indonesia. Penelitian ini dilatar belakangi oleh ketertarikan penulis terhadap lembaga yang
berfokus pada isu-isu perempuan di Indonesia yaitu Komnas Perempuan. Secara umum
penelitian ini memiliki tujuan untuk menguraikan alasan mengapa organisasi ini
menganggap isu perempuan buruh migran merupakan isu yang penting, upaya-upaya yang
telah dilakukan Komnas Perempuan dalam mengadvokasikan regulasi layak bagi buruh
migran serta hambatan apa saja yang dihadapi sejak tahun 1999-2022. Dalam tahap
penyusunan penelitian ini digunakan metode historis yang terdiri dari beberapa tahap yaitu
tahap heuristik, verfisikasi/ kritik sumber, interpretasi, serta historiografi. Berdasarkan hasil
penelitian, isu buruh migran menjadi isu yang penting untuk menjadi fokus kinerja Komnas
Perempuan mengingat sektor buruh migran telah berhasil menjadi penopang ekonomi
negara ketika meredupnya pemasukan negara dari sektor migas, selain itu jumlah
masyarakat Indonesia yang memilih menjadi buruh migran terbilang meningkat secara
signifikan setiap tahunnya, namun sebelum Komnas Perempuan berdiri belum ada regulasi
layak yang mengatur permasalahan buruh migran perempuan padahal mereka memiliki
kondisi yang rentan namun minim perlindungan. Oleh karena itu, Komnas Perempuan
mengupayakan terciptanya regulasi layak terhadap perempuan buruh migran, hal ini
terbukti dari terciptanya UU No. 6 Tahun 2012 hingga UU No. 18 Tahun 2017 yang
dianggap sebagai reformasi regulasi migrasi perburuhan. Adapun selama prosesnya,
Komnas Perempuan tidak luput dari berbagai hambatan baik hambatan wewenang mereka
yang terbatas, hingga lambannya respon pemerintah terhadap advokasi yang diberikan.

Every woman has various challenges, especially women in Indonesia. This research is
motivated by the author's interest in an institution that focuses on women's issues in
Indonesia, namely the National Commission on Violence Against Women. In general, this
research aims to explain the reasons why this organization considers the issue of female
migrant workers to be an important issue, the efforts that Komnas Perempuan has made in
advocating for appropriate regulations for migrant workers and what obstacles it has faced
since 1999-2022. In the preparation stage of this research, a historical method was used
which consists of several stages, namely the heuristic stage, source verification/criticism,
interpretation, and historiography. Based on the research results, the issue of migrant
workers is an important issue to be the focus of the National Commission on Violence
Against Women's performance considering that the migrant worker sector has succeeded
in supporting the country's economy when state income from the oil and gas sector is
decreasing. Apart from that, the number of Indonesians who choose to become migrant
workers is increasing every year. However, before the National Commission on Violence
Against Women was established, there were no proper regulations governing the problems
of female migrant workers even though they have vulnerable conditions but have minimal
protection. Therefore, Komnas Perempuan seeks to create appropriate regulations for
female migrant workers, this is proven by the creation of Law no. 6 of 2012 to Law no. 18
of 2017. During the process, Komnas Perempuan did not escape various obstacles,
including limited authority and the government's slow response to the advocacy provided.
